Abstract: Analyses the obligational and proprietary theories on the nature of the equitable interest held by a trust beneficiary, including the objections raised against each theory. Presents an account of the trust that conceives it as having two dimensions, a property and a contractual dimension, consisting of the rights and duties or liabilities generated by these two separate bodies of law operating in tandem. Discusses the implications of this theory.
